12 year old male child does not live with the mother full time?

There is no law against having any kind of apartment you want. He can sleep on a pull-out couch or folding cot in the living room.

Apartments have requirement's that single family homes do not have to meet. Like if you have a child over the age of 2 living with you, then in some states you must have a seperate bedroom for them. however if your son is only with you part time just check the lease to see how long overnight guest's are allowed to stay...most places will let your son stay with you for a weekend or even longer without having to move to a larger apartment.

What state are you in? in tx a child over 2 must have its own bedroom.

unless you are living in government housing, you can have a one bedroom, at least in Ohio.
