I spoke to the grandmother & her son (the father) told her that he gave me guardianship over his kids. She offered to have custody of these kids herself. She lives in TN and can provdie them their own room and horse (ranch) and can provide financially for them. She has money! Both of these kids Mom & Dad are unemployed, homeless and unfit to care for them. My niece-13 & nephew-9 reside w/husband his 2 kids (split custody) & I. Niece states she doesn't want to leave her friends/school. Nephew wants to be w/mom or grandma if not w/me. Im confused and want what is in the best interest of these kids. Can I have Grandma come and take kids back to TN without getting into legal trouble since we're their caregivers. Father gave Husband & I Power of Attorney & ok for guardianship. I haven't filed the paperwork due to the waiver pending approval. HELP! I don't know if mom & dad will ever get act together, should I wait until Summer and send them to TN to visit & see if they like it?

Your niece is dealing with a lot of change, but you need to decide if her life would be more stable with Grandma in TN, far away from mom and dad? Would it be helpful if there isn't the hope they will come back? Grandma may be loaded but will she have the energy to help these kids face adulthood with grace and get them through the tough teens? Maybe summers with Grandma while they live with you near their parents may be better for them. I have probably just asked all the questions that you are asking yourself. Writing it down helps a lot. Summer is coming, so I would wait until then to change anything. In the meantime, talk a lot with Grandma, I bet she would take good care of them, but it is really tiring to wrestle with teenagers. Ask Grandma about technology, can she deal with kids and computers and the internet. Talk with mom and dad, there may be a reason they didn't send them to Grandma's. Good luck.

I think that you should wait until visiting in Summer to see if they like it. You don't wait to make a big permanent change in the middle of the school year, just to have them change their minds.
