the courts will not make a judgement based on speculation, based on what you or what your neighbour thinks happened, having her dog roam is a seperate issue, but had her dog not been roaming, it wouldn't have gotten hurt.
Was there witnesses? that actually saw this attack?
The question is Why would your neighbour unlock your gate to let your dog out so it could attack thier dog? That doesn't make sense, does it to you? Only you know the rapor you have with your neighbour, and infront of the judge, be as non judgmental and kind and sincere as you can without getting into petty stuff.
Admit that your dog got out and it clearly wasn't intentional and if it can be proved it was your dog, pay the fine.

Do you want my very best advice? Is 700 the replacement value of her dog? Why not feel sympathetic and give her the 700? That way you avoid all the aggravation of fighting with a neighbor, and you don't have Animal Control after you or your dog for attacking another dog.
Even in cases where her dog got into your fenced yard, this complaint could cause you to loose your dog. I really suggest you avoid all that, have your neighbor thinking you are a wonderful sympathetic neighbor and come out smelling like a rose who was understanding and acted like a pillar. You don't even have to admit that your dog was in the wrong. It may not have been in the wrong her dog may have attacked your first. None of that really matters, neither does the 700 but having a good relationship with neighbors when you have dogs does matter.

The best thing to do is pay the fines. If there aren't any real witnesses then perhapse you won't get sued. But maybe if you keep your gate locked with a pad lock or take your dog to obedience classes the judge will be able to see your pet is not a danger to others. But if your dog is a danger it's up to you as the owner to take full responsiblity for your pets actions. They can't make good decisions on their own. They are just doing what they would normally do in the wild.

Consult with a lawyer.
You are responsible for damage to other people's property caused by your dog. The little dog was your neighbor's property. There may be contributing negligence on her part.

If your dog did in fact kill your neighbors dog outside your yard-then you are liable (what ever the law).
I would do 2 things:
1-get the facts , and document them-"know" what really happened. None of this "he said, she said" stuff.
2. try to make peace with the neighbor--what ever it takes.
You do not want to go to court unless you can ""prove"" foul play on someone's part.

check and see if there is a leash law in your town. I'd check with animal shelter as to local restrictions. Even if your dog was fenced and her's was loose, your dog's attack on the other animal is considered a dangerous animal. You'll need legal counsel regardless...

Get a lawyer because you are probably going to have to pay her the money since you are responsible for the actions of your dog.

Well your dog got out too so it isn't entirely her fault. You shouldnt be liable to pay her for anything, but you might be forced to put down your dog, being a violent animal...why is it so violent anyways? Usually dogs who are not used to other dogs just stand their ground and sniff around. your dog seemed to attack it...sry for the situaution, but dont be suprised if you are forced to put your dog down. if they were both lose, you shouldnt have to pay 700 tho

i dont believe she can sue you for killing her dog sicne her dog was not even in her yard, and her dog could have been the one to attack yours and your dog jsut defended it self... figth it, dont let her scare you, fight back ahrd.. it wasnt your fault or your dogs fault
