Ok, this is an interesting one.... my firend's ex has been arrested for like the hundreth time and she is trying to get an emergency hearing to gain full and total custody of the children, at least temporarily. She has Legal Aide and the lawyer told her to get the probation officer's name so they could get the offical results of the failed drug test (this is what put him back in jail this time) so they can present it to the judge. I know everyone will be wondering why the lawyer can't do this (my friend is asking herself the same question) but for what ever reason she can't or she won't. How do we go about getting the probation officer's name, his family is of NO help.

Two ways: (I am assuming he is imprisoned on a probation violation??)
1. Call the adult probation and parole office and ask them. They could tell you or not. Different states have different confidentiality laws. If you are the complaining witness in a child support matter, you have the right to know, but likely already would, being that you would have talked to the officer during the pre-sentence investigation.
2. Go to the court house and request to look at his file. This is public record. Find the order granting probation, or the violation, and the officer's name should be on that order. The pre-sentence investigation will also likely be drawn up by the officer.

It is just the simple matter of the criminal court forwarding the drug test results to the family court (or whatever name your state gives those two courts) because they too have that information. In reality, your lawyer should simply supeona the record, or march himself over to the court house and make a copy, but his methods are his own.

First, don't be so hard on Legal Aide. They offer reduced and free services and have large caseloads. They are able to take on more cases when the clients do the basic foot work. Would she had rather been told by Legal Aide that they could not take on her case for another 2 years? Enough said.
From what you write, the Legal Aide worker is needing you to get the name but not expecting you to get the complete criminal record. I do not think the police would provide the criminal record to a citizen, but the Legal Aide worker needs the name and fax to send a request for the record.
Start with the city where he is living. He would report to a probation officer locally. Probation officers also carry large caseloads, so there should not be too many. Call the local sheriff's office and ask for the names/phone numbers of the probation officers. They are also listed in the phone book under the government numbers. Call the probation office. Do not request the record directly (like I said, they won't give it), but do ask for the fax number to formally request a copy of the criminal record. You want more than one failed drug test. You want the entire record to show ALL the arrests.
Then call back to Legal Aide with the name, number and fax number.
Good Luck

Green creeper is wrong, inmates can and do have probation officers. Often when someone is arrested for something, their PO puts a probation hold on them. They cannot get out of jail until the PO released the hold, even if they posted bail or bond for their arrest. If the crime is serious or they've been arrested time and time again the PO may decide to revoke the probation and send them to prison to do their sentence there. Probation is in lieu of prison.

Just call the probation office in your city/county and they should be able to tell u his officer.

To tell the truth, you don't need to know the probation officer's name. What you really should do is go to court and talk to a judge. You should go through the court to legally adopt or do anything of a legal matter.

As for getting the results of his drug test, the judge should be able to accommodate you in this matter as well. He would be able to get your friend's ex's permission for the results to be revealed.

Just remember that if it is a legal problem, it should be handled by either a judge or an attorney. NOT a probation officer.

If you know what county jail he in or city you can get them to tell you by a protection order. Her lawer should have done that for her and if he/she has not, get a new lawer and sue the last one.
