i once recieved social security for my son but now he is'nt in school and i don't get it for him no more but they paid me for a extra month and now i owe them for that month. can they take that from my ny state tax refund?

Yes, it can be taken out of tax refunds but not necessarily yours. It's possible your son will be responsible for repayment after he turns 18 because I raised a grandson whom SS overpaid & I managed to payback all but $50 before my grandson turned 18 & left home. I repaid it out of his SS check because it was FOR him, in HIS SS# & I was just his payee. In the month of his 18th birthday, SS sent me the notice of his discontinuation along with a seperate notice that $50 was still owed & due immediately. I took the paper to the SS office & reminded them the overpayment was spent on him, not me & that I wasn't even aware I was being overpaid so I felt it wasn't my fault & that it would hinder me to pay it back. They told me the grandson would have to pay it back now that he was an adult anyway so they entered the grandsons new address into the computer & I've never received another notice nor was anything ever taken out of MY tax refund. My grandson has never mentioned the issue to me either so I don't know what did or didn't transact between him & the SS administration.

Yes, any tax refund can be captured for a government debt as well as defaulted student loans and back child support.

Yup. They can & they likely will. This is the thing to know about the federal government: They have almost unlimited power to rearrange your life if you owe them even a nickel, & they have no qualms about using said power. Why don't you just pay them the month back & get it over with?

If you owe any Federal or State Debt it can be kept from your refund
