am i going to go to jail if i went to a tax preparer and they made up deductions to get me a bigger return????I thought it was being done legit,,so i signed it and mailed the fed and state in when i got home my copy that i read showed deductions for real estate which i dont have and property taxes also gifts and giving to charities and work expeneses...I dont wanna get in legal trouble how do i fix it and what will happen?????

No you wont go to jail. Do an amended tax return and pay back the extra refund you recieved before you have to pay any penalties and intrest.

Go back to the tax preparer and demand that they immediately prepare an amended return. If this is done by April 17, 2007 there won't be any problems. You may have to pay any tax due, so do NOT spend the refund that you get from the original return until you know where you stand. There should not be any fee for filing the amended return since they are the ones who screwed up.

If they refuse to file the amended return, contact the IRS and file a fraud complaint against the tax preparer. You'll still have to file an amended return and pay any tax due.

At this point it might be best to contact a CPA and get it sorted out properly. You'll have to pay the CPA but then you should file against the original preparer in Small Claims Court to recover the cost of the CPA's assistance.

No, you're not going to jail.

You should, though, report this preparer to the IRS. Also, you need to amend your return to be correct and not take these illegal deductions.

Go back to where you had your taxes done in the first place, and ask to see the manager or the head of the firm, show them your copy, and tell them what happened. Someone OTHER THAN the original person, but someone at that office, should prepare the amendment without charging you for doing it. Before you go, make a copy of your copy of the return and leave it at home so you have a copy of what was originally filed.

You are the person ultimately responsible for what is filed, so you can't just let this go.

Ten to one, you aren't going to jail anytime soon. What you should do, is report the tax preparer to the head of his/her company, or to the IRS itself. The people took advantage of you, and you shouldn't have suffer the consequences. After reporting the preparer, you should go to a different place, and ask about how to file a correction. They'd be able to answer your questions better.
