Unless you are engaged in the acts of :
collecting class 3 items for investment or educational purposes, engaged in the use of a class 3 device for an approved purpose, recreational shooting,
hunting if allowed by state,
demonstration for educational or law enforcement purposes,
or actively engaged in a law enforcement operation,
or transporting the device for the reason af above stated purposes,
then the carrying of a silenced weapon would be considered evidence of intent to commit a crime.
If you're legally liscensed to carry a gun for self-defense, then the noise it makes when it is used, shouldn't be a concern for a law-abiding citizen, in the eyes of the law.
You cannot use a legal weapon for self defense and attempt to conceal the fact...that would br considered premeditated murder....because you thought before the incident to bring a silencer. And that, suggests that you intended to use the weapon and by concealing the discharge noise, hoped to avoid getting caught.

Silencers are legal in AL, AR, AK, AZ, CO, CT, FL, GA, ID, IN, KY, LA, ME, MD, MS, MT, NE, ND, NV, NH, NM, NC, OH, OK, OR, PA, SC, SD, TN, TX, UT, VA, WA, WV, WI, and WY. As far as I know, state laws only address use of silencers in general or for hunting. Some states accept Virginia’s concealed weapons permits. AL, AZ, FL, ID, IN, KY, LA, MI, MS, MT, NM, NC, OH, SD, TN, TX, VT, WV all accept Virginia’s permits.
