There's not much you can do until he gets out. I'd imagine he'll owe the back child support from when he's incarcerated, but meanwhile you're out of luck. You can probably get help from the gov't- there are a lot of programs you can take advantage of. Best of luck.

There's not all that much you CAN do. Child support is awarded based on the payer's income, and right now, he has virtually no income. What he does have is probably somewhere around 1.50 or less per hour.
If your ex had no money prior to going to jail, there's just no way he can give you money, even though he should.
In this case, if you can't take care of yourself and your kid(s), apply for federal or state funding in anyway you can. WIC, welfare, Medicaid, housing programs, food stamps, all of those are there for a reason.
Once he's out of jail, you may be able to apply for child support for the time he was in, but I'm not sure.

Try public assistance. I believe that if the father is in Prison your cant collect until he gets out.
Past-due support may accumulate while the father is in jail. But unless he has other assets, such as property or any income such as wages from a work-release program, it is unlikely that support can be collected while he is in jail. Depending on State law, your support order may be modified so that payment is deferred until he is released and working.
You are responsible for 50% of the child care anyways.

With him being in jail and no income there is not much you can do anyway....he can't pay child support if he has no income.
Have you tried applying for foodstamps, cash assistance, or the medical card? That is the only thing that I can think of that will help you.

Just like the case worker said, you can't collect from a father in jail. But, you can apply for assistance thru the state. Good Luck to you & your child.

I am in the same boat. If he is in jail he obviously isn't working so he wouldn't be able to pay, but the amount that is court ordered will be added to arrears for as long as he sits in there it doesn't stop adding up. When he gets out he will have to pay the child support plus the arrears he acquired will he was in jail

I agree, you should just apply for assistence until he gets out. Unless he has a bank account with money in it and wants to give you some he's not liable to pay child support when he doesn't have any income.

I believe you must go to the welfare agency, and they will help you with expenses and when the child's father is released, he will not only have to begin paying support, but will also be liable for the money welfare paid out to you.

If there is a bank account, and your ex is deemed to owe child support (which can be based on imputed income - while that person is incarcerated) - then, they can garnish his bank account in lieu of income, while he is incarcerated.
But, he probably doesn't have a bank account, and will probably drag you and your baby down when he gets out anyway... Best thing that you can do is move, and not leave a forwarding address so that the loser cannot contact you when he gets out of jail.
Move on!!!! Get a(nother) job
