KY law has a case Pegler v. Pegler 1995 States BAH is not used in child support calculation although the guidelines for CS guidlines say to include it. Key word 'guidelines". How does one get around this? My ex will ALWAYS receive BAH no matter where he is even if he lives in a tent or otherwise because of BAH differential due to his child support obligation is what I understand. Am I wrong or is there a way he will receive nothing?

If he is single, with no dependents, he will end up in the barracks at some point, and you do not receive BAH when living in the Barracks. That might be why it is not used in child support calculation.

as long as he has a court order to pay child support he will get BAH/Diff. Whether or not KY state law requires that BAH to be factored into how MUCH CS he pays.. is another story entirely.

But differential is never a lot of money, and probably won't make a huge difference in the amount of CS he is to pay in any event.

BAH is given to those who are residing off post. If he lives in the barracks or resides in on Base (Govt. owned) housing with his family he wil not receive BAH as the housing is considered to be his BAH. Regulations change and he may well receive BAH if he is supporting a child. You need to check with the finance office at the base nearest you.

Isn't child support calculated by the amount he gets paid? Well his base pay is the amount he gets paid extra pay like BAH and BAS and anything else like combat area or such is not really part of his pay. And no he will not always get this pay. The only thing you can count on is the base pay and just like when you do your taxes that is the only pay that counts.

Housing allowance is only given to those troops in Housing! If he lives in a barracks he won't receive this. What are you trying to accomplish here?
