I was pulled over yesterday for no reason at all. The officer said that he thought I may have been speeding. I clearly wasn't speeding at all. Was he just checking me out?

That's pretty funny....he probably was checking you out...my friend and I were driving my jeep one day (it's totally cool...big tires, very noticeable)...and I got pulled over...He said he just pulled us over to look at the jeep...then he talked to us about nothing for like a half hour!! It was pretty funny....

You asked if a police officer in California pull you over for avoiding a checkpoint. I'm unaware of any law that provides me with the authority to stop someone who simply chooses to avoid a DUI checkpoint. It would be difficult to tell, in some cases, when someone is avoiding the checkpoint versus when someone is simply making a turn onto another street. The case on point in California is Ingersoll v. Rand. In that case, the California Supreme Court specifically approved of checkpoints and noted the agency conducting the checkpoint had a procedure in place allowing cars which avoided the checkpoint to be stopped only "...if in avoiding the checkpoint the driver did anything unlawful, or exhibited obvious signs of impairment." You probably don't really know that reasonable suspicion (and that's what we go by, not probable cause) didn't exist to stop you. You might have had something as simple as a license plate light out or maybe you didn't signal as required by law (I know you said you signalled, but there are laws about the distance at which you must do so). Or, it would be foolish not to admit it, you might well have been stopped for no reason other than because you avoided the checkpoint. You shouldn't have been, but there we are. Maybe you swerved just enough that the officer felt he had reason to stop you. Hard to say, I wasn't there. But the bottom line, and the answer to your question, is that as far as I know avoiding a DUI checkpoint in and of itself isn't a reason to stop you. We'll follow you for quite a while where I work, but if we don't see what the law requires to stop you, you're on your way.

Who knows?

Undoubtedly all men notice women. Some go to greater lengths than others to get a better look.

But its unlikely that an officer did this because if superiors became aware of it he would face discipline. In some places he would be fired.

But then again law enforcement types often think of themselves as above the law.

But more than likely he was doing some kind of cautionary stop, but didn't want to divulge the details. For example there may have been an APB on vehicle like yours. But when he got closer he may have realized you didn't match the description.

Did you hit your brakes when you passed him? Because I've done that before, even when not speeding, and they pulled me over for suspicion of speeding. I'm sure there are some cops like that, but I think they probably can't tell much about how you look from where they are sitting. To me if they find a girl really attractive, they'll probably let you out of a ticket if you were really guilty of something!

Some still do, although in most agencies, this will get you fired, especially if they make some sort of advance. If the officer made a move towards you, and you know the officer's name and/or badge number, call the police agency he is with and explain the situation. If he DIDNT hit on you, it would be best just to drop the issue and forget about it.

In other words, yes, it happens, but no, it shouldn't, and most agencies will not support this behaviour.

Right...like they put their radar on the "hot chica" setting....give me a break!

If you were speeding, he or she can't usually see through your window as you go by...sit at a stop light and watch people as they drive by. Half the time you can't tell if it was a guy or a girl or what color they are...

Or you may have fit some description of someone the police were looking for.

I think that they do. They are men and sometime they might have a little fantasy in there head, if you know what I mean. Maybe they think if they stop the right girl that they will score or get some digits.

Yes. My good friend growing up became a police officer and he and all his fellow officers did it occasionally.

It's possible, there's alot of people out there who would stoop so low. Just becuase he's a police office, doesn't mean he isn't one of them...
