I have an uncle who weighs 350 and has the mentality of a 7-year old. He has attacked family members in the past and does have these "episodes" once every blue moon. We would call the police and stress to the operator that he was mentally retarded because we didn't want the police being caught off guard when he could not or would not comply with their demands.
They would come out and restrain him, and handcuff him if they had to. They offered to arrest him if we could not handle him but that was only for the safety of everyone involved. At that point it's not about accountability. The police are mostly concerned about ending the immediate threat, which would be my uncle. He would not have been placed in custody with ordinary everyday thugs. He just would have been held until a decision was made about where he should go-- back home or to a special residential center for the mentally handicapped.

If he were truly mentally handicapped, he should get a lawyer, and have him plead "insanity" or some other similar plea. It would probably be clear in the police (and/or the prosecutor, or the courtroom, if it even got that far) that the person could not stand trial, and he would not be sent to jail but rather some sort of medical center.

That depends on what type of handicap. Is he missing an arm? Then he should be arrested and held accountable. Is he severely retarded and can be proven in a court of law that the doesn't understand the concept of right and wrong? Then he should be helped.

nothing, if the family is a caring one, they will help him all his life.
i friend of mine took her son to the psi, he told the boy he had to go to the hospital. the boy got in rage, got a knife to kill the Dr. his mother, my friend, got in front and got stabbed, died. terrible thing for the family, grandparents, father, etc. they all made a circle around the boy, and have given him love all his life.he is a schizophrenic. to Marinilda, hope you are in heaven
