Ashley there is a saying that kids will be kids I have a 4 year old and 1 year old whom is 17 months. My babysister watched me when I was little and my 17 month old is a typical little person whom climbs on everything and he comes home with bumps and bruises a 9 year old can get upset with parents and be mean. My suggestion as a parent is if you aren't comfortable with the babysiter change baby siters and you should pay the woman. Reguardless she can take you to court or contact the countie attorney.

Babysitting is a service just like any other. This means that you have to pay for the service, whether you are happy with the results or not. (Imagine if parents could choose not to pay the babysitter if their child had an accident -- or didn't have fun -- or had a bad day. Those problems are just part of life with toddlers!)
But if you're not happy, you should "vote with your wallet" by not buying that service again. So if you don't feel that this babysitter pays proper attention to your son, you should find a better caregiver.

What did she do after he fell? If she was on top of it, gave him ice and did everything she could to make him feel better... then she probably did her job.
If she admitted to being distracted for a moment (and just for a moment mind you), then I still wouldn't hold it against her. It's pretty hard to intently watch a child for an extended time. The other question... was he riding it in a place where he's normally allowed to? If she let him ride in the street, that's different.
I've watched my child take a spill a time or two. It's an unfortunate part of growing up. I'd pay her. If you don't trust her. Don't use her again.
Only refuse to pay if you're sure she was completely negligent.

Yes you should pay the babysitter. Toddlers fall down all the time. And how do you know that the babysitter wasn't paying attention, or that she could have stopped you son from falling if she had been paying attention? What if you had been there when your son fell; would that have been the babysitter's fault too? In order to not have to pay her, you would have to prove neglect.

Sometimes you can't be watching a child 100% of the time. Think back are you watching your child 100% of the time, there are probably times where he's out of eyesite. Is she a baby sitter or a day care provider, how many children is she watching. Things to consider in the future if you continue to have :"accidents" happen. For now, she did the work, she needs to be paid. If you don't like the care given, you'll proably need to look for another place to send your child.

Pay her what you promised before she agreed to watch your son. If you don't trust her now, don't call upon her services again & find someone else.
Remember that toddlers are accident prone & can fall even walking through your home from room to room, resulting in the same exact injury or a different one.
If you don't pay her, I hope she spreads the word around that you are a lousy employer & that you never get another sitter. I was jilted once by a family being their nanny because their paycheck was short for them getting off early for a vacation that I stayed home with their kids for. I immediately gave 2 weeks notice & spread word around to other nannies about what happened. I found out that this family was notorious for it too. They ended up moving because no one would watch their kids.

Yes you should pay her. If you don't trust her anymore then you should get another babysitter. Just remember that accidents happen and that it could have happened with anyone around. I know it's hard though when you kid gets hurt in someone elses care. I'm guessing that since he's 2 that he has probably been hurt sometime while you or your husband have there. I hope this helps!!

I would pay her, but not use her again if you think that she was really careless. Kids fall all the time and get hurt. It doesn't sound like his injury is very serious, just a bump on the head. How do you know that she wasn't paying attention? I assume that your 2 year old can't really tell you, so I'm just curious how you came to that conclusion. If you felt that it was neglect on her part, absolutely don't use her again and I would tell anyone else you know with small kids not to use her either.

yes you should pay her....when my son was 2 he fell off a step leading outdoors and split his lip completely in two when he hit it on a gas can that was sitting (empty) by the back step.....it required plastic surgery and half a days pay for me because i had to go to the e/r...if you didnt feel that your sitter was competent enough to care for your child then you shouldnt have left him....that having been said, you should take some responsibility for where you leave your child....accidents with toddlers happen all the time......count your lucky stars it wasnt worse and pay the sitter

I wouldn't pay her if she wasn't watching him, but are you sure she wasn't? Make sure you know the whole story before you don't take care of your sitter. You have to remember, accidents happen with little ones, even when you're keeping an eye on them. I know that it hurts to see your baby hurt, but at least take the time to find out if it really was neglect of just an unfortunate accident.
