My neck was injured 5 months ago. I still get headaches daily that the Dr. says arent going to get better. I can still work but thank god I'm self employed because Icant work close to the level I could before the accident.I had an mri and have perment damage. there was some damage before apperently, but the accident set my neck off. Any advice?

I don't think you can realistically come up with a figure, so much depends on age, work history, wages earned history, whether or not you are permanently disabled and to what degree, or are you permenently partially disabled. They will bring into the matter of you having a pre-existing condition, they will check your medical history, Dr's seen, when, where, for what. You should get a lawyer that will go to court based on "no win, no fee". If you don't go that way, the hourly costs will bury you. They typically get 33% of the total awarded to the client. Regarding the headaches, purchase a soft foam cervical collar, 20bucks at Walmart, you can wear it daily to ease some of the muscle strain in your neck, also apply heat or ice(I prefer heat). Ibuprofen daily for inflammation, these examples will ease some of your pain, I'm assuming your neck is at issue, because of the headaches. The headaches will get better, and stop actually once you get some of the inflammation down.

Your question makes your injury sound sort of squishy.

You had a pre-existing injury exacerbated by the accident.

Since you sustained no new objective injuries, just an exacerbation of the previous injury, my bet is that your settlement will not be a "sky's the limit" settlement like a guy would get if her were seriously disfigured in an accident.

I'd bet your claim will be handled the same as folks who have no objective injuries whatsoever. They say they hurt, but nothing shows up on an X-ray or MRI. Nobody can tell them they don't hurt, but "soft-tissue" injuries aren't considered serious or permanent.

If you are not represented by an attorney, you'll probably get three or four times the amount of the medical bills you incurred.

If you have a lawyer, you'll get 30% more, but then you'll have a lawyer to pay.

I agree with Soar. GET A LAWYER! You cannot deal with the insurance companies yourself. You have no idea what you are entitled to, and they certainly aren't gonna volunteer that info. It's far more complex than you can imagine. It's worth giving a lawyer his cut. Some don't charge if they don't win.

I got $2000 for one I was in a few months ago, but after the hospital bills and rental, it was only abot $300 for pain and suffering. good luck.

Sounds to me like you need a lawyer. Be careful, get the best lawyer you can find. This is not a time to be cheap.
