Its not that simple. If the lender can show they have tried to pursue the debt... then the debt stays legally binding on the debtee.

If the lender hasn't contacted the debtor in 6 years, despite having his contact details... then there may be a case for limitation of debt. If they chase him up after 5 years and 364 days... then the debt is still active for another 6 years afaik.

BTW - don't take debt that you can't afford to repay. PAY YOUR DEBTS !!!

However it can be compicated by debtor moving.. and lender claiming tried to pursue it... and debtor saying had no idea ect... I think the courts would find in lenders favour if they can show they tried to pursue debtor.

from what i knew it was 6 years..if the debt hasnt been retreived in that time then its wrote off. ring CAB and see what they say.
Well have just found this:
The council should not go to the magistrates court and ask for a liability order for council tax if the application is made more than six years after the council tax became due. This is under Regulation 34(3) Council Tax (Administration and Enforcement) Regulations 1992.

Council tax appears to be “due” when the council sent a demand notice to you which may not be at the same time the council tax rate was set. It is important that you check when the demand was sent as this affects when the 6 year limitation period begins. You can also complain to the Local Government Ombudsman if the demand was not sent out “as soon as practicable” after the rate was set.

Check out the website....hope it helps

Please don't tell me the world is coming to the point where we decide 6 years later that we don't want to pay out taxes, or other rightful debts !!!

What ever happened to our word being good as gold ? If he owes the debt, tell him to pay it.
