On usually refers to being on the surface of something (a car on the road, man on the moon etc).
In usually refers to being enclosed by or within something (bird in the hand, stuck in the middle etc)
To be 'on' a tree would mean being on the outer surface of the tree whereas 'in' would mean amongst the branches and leaves.
In this context a bird's nest would be IN a tree.

I think both statements can be true as some birds may actually build their nests in the tree, as some Owls do, and some build their nests on the limbs of the tree.

I would say either are correct as some build nests within the con finds of the tree and some build their nests on the perimeter of the tree.
