Likely they can call it "new: forever, since this is not a regulated food term, and even if it were, they could make a very tiny change and be "new" all over again. Add one more grain of salt or sugar and voila! New!!!!

with the one product they left new on there product for a year and then aftwards took it off the shevle. so i guess as long as the manufactere wants to
