It depends on the stipulations of that particular person's probation. For instance, someone who was charged with an alcohol related crime might not be allowed to be around alcohol at all or have it in the house even if it belongs to another person.
Someone who has a check forgery charge might be allowed to be around alcohol and drink but not to excess. (they aren't allowed to be drunk)
So, if a person's probation prohibits the person from being around alcohol, if caught (even if they aren't drinking), they would go back to jail, or prison.

Of course, you can get in trouble. If you are on probation you should know the rules. If not find out. But then again, you can get in trouble in a house where no one is drinking. It depends on what happens while you are in the house.

Gee's you all have it rough in the states. The Police in Australia are only uniformed Social Workers. The Court system also is one big joke as well. If you were on probation here you have to turn up to a police station once a week to sign in. Otherwise you can do anything you would normally do. Most people who get arrested are back on the street within an hour.

It depends on the rules in your state. In my state, the terms and conditions of probation state that probationers are not to drink or possess alcohol, or be present in any establishment that gets its main income from the sale of alcohol. Being present in a private residence where others were drinking would not, in itself, be a violation.
However, if the people in the house were violating other laws, that would violate the prohibition of associating with others involved in criminal activity.

Oh God no. You also can not get in trouble for using drugs or committing other crimes while on probaiton. Did you know that you actually don't even have to report to your probaiton officer. You can actually do what you want. Then if they arrest you and bring you in front of the judge you can tell him to f off.
You can do anything you want to do as long as you wont mind being someones boy toy in an 8x12 cell for a few years.

YES... my daughter is on P and P and I can't even have beer in my refrigerator when she visits because if the P.O. were to come in and find it, they could send her back to prison.
