i was in the same place as you when i first met my bf. he was 18 and i was 16-17.
he used to be very worried about it.... even IF you say you give consent, someone if they wanted to, could STILL prosecute.
he might only be in jail for a very short time (depending the seriousness of the case) and then he would have to register as a sex offender for the rest of his life. he would have to follow the rules being one... such as he wouldn't be able to live near school's or parks... he would have to let everyone in his neighborhood (where he was moving) know that he is a registered sex offender. and this WILL stay on his record, so he will have a hard time getting a job for this.
i say wait until your 18... BUT....
my advice... i understand that you are young.. and you are going to experience things like this... so, make SURE that you are ready to do this... make sure you and him are aware of the risk (legal and biological, ie. STDs, babies).. and most import and USE PROTECTION! and be careful.

In the end it is up to you. I have to take your work on the AOC for NY. What you may want to look into as well is the age gap that is allowed though. Some states allow for an under 3 year age gap. So that someone who is 18 will not be prosecuted because there significant other who is 5 months younger happens be 17 still. If you are really concerned though just wait. It's not gonna be that big of a deal to wait. If you can't wait just don't tell anyone if you're still that scared.

He could go to jail. He could get community service. The punishment is dependent on the judge. Most though will serve jail time (on average in the U.S., about 20 - 25 months). The hardest part of the punishment though is a permanent no contact order, meaning even after he gets out, you will probably not be allowed to see him or talk to him or anything. Most people convicted of this crime have this added to their sentence. You can appeal to have it overturned when you are 18, unfortunately it hardly ever works.
Also, he isn't thrown in jail the second anyone finds out. Only your legal guardians can press charges against him. So if they are cool with it you have nothing to worry about.

16 and having sex with a 19 yr old yes he would go to jail and what would it matter how long he went to jail for sometimes some people don't use there head and alot of people get hurt if you want everyone to know then whatever but don't sit and ask for how long right is right and wrong is wrong think about it

most states won't prosecute at or above the age of 16...it is considered the age of consent...and, it would be a lot differant if he was thirty and you were 16, but there's only 3 years difference...i wouldn't flaunt the relationship but unless you've got some hard-*** parents or a local DA on a crusade, i wouldn't worry about it

it depends in which state ur in, in NY ur considered underage and if somebody finds out he will be registered az a sex offender for engagement in underage sex .
