Call your local agent, not the main office of the insurance company, and ask him to find out what the hold up is on getting your settlement. Assuming the accident wasn't your fault, are they furnishing you with a rental to use in the meantime? If not, ask for one.
Contrary to what others are telling you, I wouldn't get an attorney involved, and NO, the insurance company doesn't "Have to pay the attorney bill." The attorney will take his fees out of what you get in your settlement.
Keep in mind the insurance isn't in the repair business, all they want to figure out is which will be less, fixing the vehicle or totaling it. Are you doing your part and letting the adjuster have access to the vehicle?

Check with your state government agencies. Most states have an insurance commission, that determines their ability to sell insurance in your state. If this is the result of an accident, and the blame for the accident isn't yours, try your coverage for uninsured/ under-insured motorist. That should get it fixed, and your company will get the reimbursement from the other party. Also, you might try your state Attorney General office website, usually listed under consumer protection department. They should have info on your rights, and also have resources for you to contact for assistance. I would try these ideas before you hire a lawyer, because of course, if you lose you will have to pay the lawyer.

Gee...have you asked THEM what's taking so long? Is your car at a shop being torn down? Is it a borderline total loss? Have repairs started or not? If your car is at a shop, the insurance company relies on the shop to get the info to them in a timely manner....the shop will say they did, the insurance company will say they didn't....trust me, the shop didn't get the info over to them. They want your claim closed & gone just as bad as you do.
You said so yourself...being angry on the phone doesn't work--as a matter of fact, it gets you nowhere. Try being patient for a change. I know you're frustrated, but yours isn't the only one being dealt with at a shop or the insurance company.

Write down exactly what you want them to do.
Call them and demand they do this within a given period (say, 10 days), or you will hire an attorney.
This is a real threat to them because once an attorney is involved, they will have to pay his fees on top of your repair bills.
Don't hesitate to hire an attorney if they get snobby with you. They deserve to have to pay extra for mistreating you!
