I tried to do my taxes and the company where I filed said my kids have already been clamed. So I called the irs and they told me to file on paper. How do I do that??? What will be done to the person who filed my kids pleas help!!!!

Have your preparer print out the return and mail it in
When 2 people claim the same child on a tax return, It raises a flag with the IRS. They will first send a letter advising that the same SSN was used twice and advise that the person who was not entitled to claim the child needs to file an amended return. Then if no one corrects the return the IRS will request from both parties to submit proof of entitlement to claim the child. The IRS will then make a detemination on who is entitled to claim the child and it the person who is seen as the one NOT allowed to claim the child will owe back any refund they received in reference to the child along with penalties and interest and their Tax return will be flagged for review for up to the next 10 years

I suggest you take the advice of Rob or Bostonian and not that of "bold4bs" as he has overlooked some things. Most tax prep companies today file the returns electronically. By the very next morning, we have a report from the IRS of any that were rejected and why. It's this report that tells the tax prep company that the dependents have already been claimed by someone else.

File a paper return and mail it in. The IRS will contact both taxpayers and ask them to justify the exemptions. Don't delay in responding to that letter! The IRS will examine the evidence provided and then grant the exemption to the proper taxpayer based upon the law and the proof provided. The other taxpayer will get a bill for any additional tax that is due because of the denied exemption.

The company preparing your taxes I believe has lied to you. There is no way they could have known that your kids were claimed by someone else - those records are confidential; unless the other person prepared their taxes by the same tax prep company.

You must ask yourself this question - Whom provided more than half of their "economic
support"; if you can prove it was you, I would highly suggest you file your return, as Head of Household, claiming them as dependents. You will get the additional exemptions and better standard deduction, and your refund will be sent. You have not committed a fraud by doing this. Dont Worry.

After you receive your refund; maybe 3 months later, you will receive a letter from the IRS that you erroneously reported the same dependents on your return when they were claimed on someone else's return. That is when you must prove your case.

Make an appointment with your local IRS district office. Tell them what happened, they will forward you a form in which you will provide the details of your support. An IRS
determination will be made, either for you or against you.

If the latter takes place, you will not go to jail. You will then have to pay the difference
in tax and pay penalties - an installment agreement will be arranged, if necessary.

This scenario quite often takes place with divorced parents. The IRS is quite accustomed to handling these situations.

You can print off the forms at www.irs.gov and fill out your tax forms and mail them in.

The IRS will go after the fraudster and assess penalties and interest for claiming your children, if they do not have the right to claim them.
