No other car involved, car slid and hit a bollard. Road surface had coal granules and diesel mixed on it and as the Police have said it was the equivelent to driving on ball bearings! The council has a contract with the opencast which leads onto this section of road to clean it! A week earlier another car crashed at the same site and we now find out the road was not cleaned after this report. The insurance group say it may be difficult to prove the cause and to accept responsibilty. The police have said the would support us fighting this.

I'm not sure I understand your question. Obviously the insurance company has assigned fault and the person at fault is responsible for the losses suffered by the other party.

If this is a collision claim, you are obviously already at fault, and the company will pay your losses less your deductible.

If they have decided you are not at fault and want to pay you, and you say "Wait a minute, this really WAS my fault" they will happily not pay you. Is that what you are asking?

Please clarify your question.

Can you find out who the other person was that crashed? If the police are willing to help that seems sensible. I think you need something in writing from your Insurance Company detailing the reasons why they want you to accept responsibility. Why is your insurance company wanting you to accept the blame? This is a first, usually they do everything in their power not to accept the blame. Do you have comprehensive cover? If so that should also have law cover on it if you want to fight the case. This seems very strange. Find out if they will take away your no claims bonus if you do accept the blame? Even if they dont it is a black mark on your insurance history. I really think you need to look further into this. Go to one of those free consultation law firms and speak to them, if your insurance company insists on you taking the blame.

I am assuming that you told the police when they investigated the accident that it was your fault and therefore by saying that you made yourself the responsible party. Now you find out there are extenuating circumstances and want your insurance company to say you basically didn't notice the road conditions at the time of the accident.

It depends on where you live and what the negligence laws are where you live. Do you live in a pure comparative state? A modified state? or a 49% or more state? It comes down to how much you are legally able to recover BACK from someone or something when liability is shared between the involved parties.

It may not be your fault, or partly the other person's fault. The insurance company should not have to pay for other people's carelessness or lack of responsibility.
