how do i found out if the IRS has received our injured spouse form and how long does it take to get back my portion on the money?

Contact the IRS @ 1-800-829-1040 to confirm receipt of the 8379 it usually takes 8 to 12 weeks to process the Injured Spouse Claim, if sent separately from the return. If it was sent with the return it may add approximately 6 weeks to the processing of the return

If you filed a paper return with the ISA Form 8379 attached, it usually takes about 8 weeks to process.

If you e-filed and followed up with the Form 8379 it can take several months to process since the offset may have to be rolled back from FMS and possibly even from the recipient of the offset funds. And if it was for child support it may not be possible to roll it back if the recipient has already been paid by FMS

If you filled Form 8379 with your tax return electronically it will take 11 weeks to process the request and to send the part of the refund that belongs to the injured spouse. 13 weeks if the form if filled by paper.

The state that you live in also may require its own injured spouse form.

It can take a while. Anywhere from 6-8 weeks if everything is very clear to up to 3 months if there are questionable items.
