I filed my 2006 taxes already, and they took the full refund to pay outstanding student loans for my new husband, whom I married mid 2006. I filed the injured spouse form showing that all income was mine, none from him at all. What will happen to my refund?

When you file the Injured Spouse Allocation, you should ONLY file a paper return and attach the Form 8379 to the return. When you do it that way, your return should be processed and your refund paid to you in about 8 weeks.

If you e-file your return first and then mail in the ISA form, they have to roll back the offset of the refund before it can be paid to you. This takes time. If the funds have already been paid over to the beneficiary through FMS by the time your ISA is processed, this can take a long time to complete -- sometimes as long as a year depending upon the circumstances.

My husband had a bill for child support some years ago. The IRS took a big chunk of my refund. I was the sole provider for that year. The debt existed before I married him. I filed Injured Spouse and intercepted. Got all of my money back. As long as the debt was existing before you married him, you should get it back.

you would be entitled to receive the refund. however, the Injured Spouse form must be mailed in. It is manually reviewed and will take approx. 8 weeks to get your refund, from my experience.

That stinks. Check on the status after 4 weeks. Make sure they are aware you filed it. Most IRS agents are temps for the season so they may not know all the answers, but they are usually pretty nice and helpful.
