My sister got hit for a car that was leaving a gas station. She went to get some estimates from a body shop and the first she got was for over $6000 because they want to replace almost all the damaged parts; the other estimate is for around $3500 because they will repaire some parts. This is a new sienna (2004)with few miles. Will Insurance pay for the higher estimate? This accident will increase the future premium if the other ins. do not want to pay for the repair? The accident was not my sister fault and the other driver was not added to the policy of the car that he was driving.

THe issue of who pays is clear, both the driver and the owner of the other vehicle are liable. If you have non insured motorist on your policy that is what it's there for. This should not increase your sisters premium. And what the Insurance company will pay is beside the issue on this one as what will it take for your Sister to be content with the repairs. a so so job or the best. If it were your insurance then you would have to settle for their answer. If you don't like the settlement don't take the check and don't sign a thing until the settlement is adjusted. Just because they say this is our final offer, an accident attotney can get them to change their mind, they don't want that so just throw that threat and see what happens. Insurance adjusters are trying to give you the least amount of cash for the trouble. Make sure you can live with it...I deal with insurance companies all the time

The answer: Absolutely not.

The insurance wont even likely go off estimate you go: one of their appraisers will take a look at your vehicle.

Plus- they will ALWAYS repair a part if it is more cost effective then replacing it and can take it back to preloss condition.

Not only that- but they have the right to use aftermarket and used parts as well so the estimate will likely go lower.

You can be sure they will get your vehicle to preloss condition- so dont worry about it. But if your just trying to pocket extra cash that they dont owe- no way jose.

Insurance will do their own estimate and pay that amount. They will allow for lower labor rates and will not allow for replacement of parts that can be repaired. They will write an estimate for like kind and quality parts, not new parts as the vehicle is not new.

Insurance companies don't just "pay out" based upon YOUR estimate alone.

They send their own adjusters to look at the damages and derive at their own conclusions of how much it will cost to repair.

They will repair it, don't worry.

sometimes they give you a choice. if, for example, the first place will also repaint and do body work, while the 2nd place will leave it ugly and just put it back into mechanical working condition.

imho, go back to the second place and ask for a new estimate that covers all work.
