Why in some states like PA do they not have to pay sales taxes on certain items like clothes?

It's all based on the local laws. Different states have no sales tax at all...or no sales tax on clothing and/or food. I grew up in Delaware where there is no sales tax. I also lived in PA as well and had to pay federal, state AND local tax. Here where I am now (MN), there is no sales tax on clothing or food items. My parents live in FL and there is no state income tax.

It just depends on what the state law is.

Each state legislature decides what will be taxed in that state, and what the rate will be.

The PA legislature gave Philadelphia and Allegheny counties the right to levy an additional sales tax also, which is why the rates are different there than in the rest of PA. In a number of places besides PA, there are sales taxes levied by municipalities as well as the state.
