My car has been in repo status for the last 8 months and now there is a private investigator (alleged) calling me threatening to put me in jail. Is this true? Can I go to jail? I don't want the car because it is a lemon, but I need it for a lttle while longer. I have a baby and no one to help me in getting back and forth. Please help with any advice or suggestions because the car is not worth going to jail for!

I guarantee that the person calling you is not a Private Investigator. Both a P.I. and a creditor do not have the right to put you in jail. The only way you can get into legal trouble is if you have failed to pay for the car and are hiding it from them. In that case, the car is no longer yours and you are keeping it from the rightful owner. That can cause you criminal and civil penalties. Most of your problems will be financial, and not just the cost of the car. You will have to pay for their legal fees, recovery fees, etc. and those will not be covered under your Bankruptcy protection. If the car is a lemon, that doesn't mean you don't have to pay for it. If it qualified under the "lemon laws" you could have it returned it right away.
If you are going to file Bankruptcy, do it as soon as possible. Creditors play dirty and things will get worse before they get better. If you don't do it soon, you can expect harassment at your front door, not just on the phone.

When you file bankruptcy, there will be an automatic stay put on any collection or repo activity. The creditor will have to get permission from the court to repo your car, and that will take a few weeks.

File ASAP, and that will stop the guy from calling you.

BTW, a creditor can't put you in jail, unless you are intentionally hiding the car. He can't threaten to do this either. Talk to your bankruptcy attorney.

ask your bankruptcy lawyer; once you file, there are certain protections and you may not lose your car.
