but he has the only pair of keys and i was wondering if i can go pick them up. but the car is in his name he wants me to take it to my house. so what can i do?

It is up to the cops and the DA if the car is impounded. If it is evidence in any way they will probobly not let you remove anything. If it is not impounded, go to the jail and ask. If he grants permission to release personal property to you (the keys) they will.

You would go pick up his personal property from jail, he can sign a paper for you to do this.
