I work in insurance in the state of Texas...and from my experience here in Texas is that if you have an accident and the other driver does not have insurance you MUST make sure that you report it to the police so that you can get a police report that is an official report stating all of the drivers and/or passengers information and that the other driver did not show/have proof of financial responsibility(minimum required liability coverage). Then and only then will your claims adjuster think of providing coverage under your UM(uninsured motorist) benefit. Remember it is always wise to let your insurance agent/company know if an accident has happened because you never know if that other driver will call up and try to file a claim against YOU. Protect yourself!

You report the accident to your insurance. They will handle everything and fix the car for you IF, and only IF you have "Uninsured Motorist" in your policy.

Only they can tell you if you do, so call them and ask.

If you don't, you are responsible for taking the steps necessary to repair the vehicle. This includes either paying yourself, or taking the other person to small claims court if necessary.
