i work for a bank and you would have to take legal steps. because you didn't do the transaction and the person is not on your account it is considered fraud. the bank will most likely close your account and put this account on fraudulent status. then they will open you a new one. the next steps is if you want to press charges or not. if you don't you will most likely be responsible for the charges. the bank will only pay for them if you put fraud against the person who did them and if you can prove it wasn't you. that's how my bank does it.

You would have to take the required legal steps if you want to get your money back. If it is a household member that you know for sure doing it, ask for the money back. If the household member is family, you would have to decide whether or not to press charges. In the meantime, notify the bank and change your account number asap.

If the person used the card without your permission, you can claim fraud. The bank will want to prosecute the person who used the card though. That person will have a criminal record and will have to pay. If you don't want to use that extreme of action, you can pay the bill, then ask the person who used the card to pay you back, and if they don't you can take them to small claims court.

You would have to file a police report first. Keep in mind that the bank will prosecute your family member, and bank fraud is a federal offense.
