Do I have the right to have a copy of the will my x-husband left, with regards to our three minor children? His brother is the executor of the will and is unwilling to give me a copy. I am told also that I am to receive $3,000 and a "Thank you", from my ex, but my x-brother in-law says he will dole it out to me in replace of the child support my ex would have been giving me rather than letting me have it all at once. Also, he says in the best interest of the kids, they CANNOT have any of their money, except for if they have a child, get married, or other significant occasion. I am concerned about my finances and loosing my house, now that I will no longer receive child support. My entire budget/income level etc..is based on including my child support with my earnings and now that he is deceased, I will no longer receive it. My ex-brother in-law says "you're just gonna have to tighten your budget". We do not live a frivilous life. We don't even have cable TV. not sure how to cut

I am not sure why your ex- bil is will not show you the will, but I have found that greed kicks in when estates are at stake. Your children should be the benefactors of the majority of his estate. This has "get a lawyer" all over it. Many lawyers will work pro bono for a case like this...
If you are in the US, then talk to social services...you should also have some social security checks coming in for your minor children as well. They can also refer you to a free or sliding scale lawyer. Good luck! dd
edit: I also agree that it is best not to hand minor children a wad of cash, but their portion of the estate should be invested and placed in trust with a neutral party overseeing it. Provisions can be placed on the money so that they may access it at specific times and for specific reasons (college, purchasing a home, etc.) . PLEASE get a lawyer!! I have seen some really terrible things happen when it comes to estates. As executor, his job is simply follow what is stated in the will, not to make up things that are not stated because he feels like it woud be best this way or that way.... He is in grief right now and I understand some poor judgement, but you have children to protect, and by law, as his hdirect heirs, they should be the recipients of the majority of his estate.

No telling here. You might be the evil ex wife for all we know. However, assuming you're not evil, I'd advise you to just get a second job or find a roommate to move in and help pay for things.

You could advertise for another working single mom and you two could split the bills, etc.

U r entitled to maintenance for ur children from his estate. U can also get copy of the will if u ask the court to issue necessary directions on ur application for securing maintenance for ur children.
