The Supreme court verdict was for 13 MLA's only, for the remaining 24 MLA's the ball was pushed into the court of the Speaker of the Assmbly. But, the possible reasons for the Congress not imposing President Rule in UP may be:
- Lack of Support from within UPA parties;
- Lack of confidence in BJP, which did not declare absolute support;
- The analysis of pros and cons of imposing the president rule ,for the Congress as a political party did not favoured this;
- The Supreme Court in General does not favour implememtation of Article 356, without confirming vote of confidence in the assembly;
- The elections in the State being so near , the benefits would have been too little'
Considering all these Congress might have dropped the idea of imposing the P.R.

The Supreme court had not asked the Union Government to impose President's Rule in UP.There have been instances in the past when the State Governor of Bihar had recommended President's rule there and the Supeme Court had struck down the Ordinance as uncostitutional. With that loss of face and with a Coalition ally strongly against the move, Congress found it more expedient to let the Election Commission go ahead with the Scheduling of the election. We might in all probability, see for the first time in the Constitutional history of India the spectacle of the Election of India recommending that the Administration of election cannot be carried on in accordance with the law of the land as the Care taker Government is breaching the code of conduct and accordingly recommend the imposition of President's rule in UP!
