divorce (other than reconciling our difference)? Me and my wife aren't getting along and I'll be moving out of state.

It truly depends on the state you're living in. I could cite Texas law to you but that would do you no good if you don't live in Texas.

In almost all states - the "grounds" for the divorce have NO impact on the resolution of all the issues you mentioned. For example - child custody will be determined based on what is in the best interests of the children - regardless of why the parents are getting divorced. Assets will be separated according to the laws of your state - community property or just and equitable division. Child support is most often determined by a mathmatical formula that takes into account the income of both parents and the expenses of the children. Alimony will depend on the needs of the one parent, the ability to pay of the other parent, the length of the marriage, the reason one parent needs help, etc.

The grounds given for divorce are generally old fashioned especially in the US where we have "no-fault" divorce.

Good luck.

I'm sorry you didn't mention the state in which you were residing with your spouse and children. But in California, the laws are very clear that it is considered a Community Property State. Which basically says you each share half of what you own regardless of who made the better income. Child support is taken very seriously. You don't pay or quit your job thinking that is a way out of paying to help support your family is no excuse in the eyes of the law. The likely hood of being prosecuted and do some jail time is very real. (Please don't deny your kids this ) Just because of the lack of feeling for your other half. Your spouse can also go for part of your retirement plan(Pension). I could on and on about this subject but I am running short of space. Take Care,
Marseille

I fyou leave the state, you are leaving your kids. If you, for some odd reason, got custody of the kids, your ex could most likely make you stay in the state. If your wife didn't work to stay home and take care of the children and the household, she probably would be rewarded some kind of alimony until she could get back on her feet. Have you tried counseling?

In Colorado it's a 50/50 state. If you don't live in the home with your kids you must pay childsuport. This state says it's the kids money not yours or your ex's.
Remember your child is still your child, no matter if you two aren't getting along.
As for the assets, like I said this is a 50/50 state.

I suggest that you should file for a divorce and resolve the issues before you move out of state.

Otherwise you could be in a big mess.
