My son keeps getting kick out of daycares due to his disability.
Is this fair? Can daycares kick him out due to his disability?
Is there any daycare centers that take care of children with disability's? His disability is SPD and ADHD and he is on SSI for this.
Also it is possible that he might have Autism or be Bi Polar.

He has been kicked out of 8 different daycares. and They had told me that it is due to his disability.
I thought this was against the Disability Act.

It isn't against the Disability Act if its a private facility and they kick him out because they don't have the knowledge or the proper facility to handle his disability. Private facilities are not required to meet the needs of the disabled like the public facilities have to unfortunately. I would check into it and see. If you are having problems finding a daycare for your child, call the local SSI office or health dept or even a daycare and ask who would be able to handle him. Let them know all of his special needs up front.

You are probably dealing with private daycares- if the daycare happens to be at your place of employment- then you may want to see a lawyer because that would be considered an employee benefit and therefore they couldn't deny you that benefit---you should have your son re-checked by a doc about the bipolar and autism -- and they may know of "special" daycares for children with your sons needs.........good luck to you and your son

I suspect that it wasn't the disability as much as his actions toward the other children and his removal was more a safety/security issue than discrimination. But, because when push comes to shove, his actions are a product of his disorders they probably were cornered into saying it was the disability.

because daycares are private schooling, they cand pick and choosse who can be in or not. your besst bet is to find a daycare developed for disabled children
