My son keeps getting kick out of daycares due to his disability.
Is this fair? Can daycares kick him out due to his disability?
Is there any daycare centers that take care of children with disability's? His disability is SPD and ADHD and he is on SSI for this.
Also it is possible that he might have Autism or be Bi Polar.

He has been kicked out of 8 different daycares. and They had told me that it is due to his disability.
I thought this was against the Disability Act.

Private day cares can kick a child out for misbehavior, disabled or not.

Depending on your child's age, he may be able to go to preschool at your local public school. Contact your local school board for information.

Also check with your local Head Start office. They may have information about special needs day care. You might also look into whether or not you have an early intervention center nearby, a community college or university, which often has a good day care program, and your child's pediatrician.

If your son's behavior is so out of control that he's been kicked out of 8 day cares maybe some of that SSI money needs to be spent on behavioral therapy. School is going to be rough for him if he can't make it in day care.

Have you considered private day care? Either an established home day care, or maybe a college student or nanny who can take care of your child during the day.

There is also an organization, Center for Autism and Related Disabilities (CARD). They are in most cities and are often affiliated with a university. They may be able to help you with information about local day cares. They will also come to your house and help you set up behavioral supports for your child for free.

It is really important that you get the behaviors under control as soon as possible, or his school career is going to be bad for him and worse for you. Good luck!

But yes, kids with disabilities can be kicked out of daycares. They cannot be kicked out of public schools if their behavior is a result of their disability.

You don't say how old he is, but the money from SSI should be used for behavioral intervention therapy, or you could use it to hire a respite care worker. At age three, he could also get services through the local public school system, daily classes as well as therapy.

He can be kicked out if his behavior is out of control. This is not a violation.
