The judge will apply the law of the cited case in his decision. Both lawyers will make arguments, and the one most convincing will prevail.

The judge will, because the judge is the arbitor of the law.

But that does't happpen because the two sides are going to pick cases that went their way. It's unlikely for a plantiff to cite a case where the plantiff lost.
