and the wife is not a citizen, does not work, does not want to work, has a drinking problem. lives with a mother who has a drug and spending problem, and also hangs out with a drug provider...and we think gets drugs for her mother's habit, leaves the house at 11PM 4 nights a week and stays out all night...tells her hubby all she wants to do is "drink and f___k"... can she be deported or will she be entitled to welfare as she believes is the case? He really wants custody but is told the best he'll get is 50-50.

Sorry, it is a very warped and dysfunctional group. She was the sweetest thing till she had a child and became a beech on wheels.
Any opinions? I am at a total loss that people live like this. Help, Please!

She's not a citizen, came here with drugie mother from Venezuela and who's on husband #3.

If she is not a citizen, I believe then they would have to be married for two years for her to become one. If he can prove that she has a drinking problem and is endangering the welfare of the child he may have a shot at custody.

Regarding custody of a 2-yr child, I think the mother doesn't have the right to it since the child will not be in a good environment in staying with a mother who is drunkard and may not give a good example to the growing child. Check if drinking started only after marriage, she might be having a depression and emotional problem (it could be the marital problem that she wants to forget so she resolves by drinking). The citizenship may not be a problem of deportation since she is married to the citizen of the country she stays in, so she has a reason. The husband should also realize that this is not a simple problem for mothers, thus why not talk it over with her with maturity and check first, there may also be problem with the husband. Give her the attention so she can express what she really is suffering and find the best solution. The help of an older relative or authority for her to discuss the reason of her acts may be needed. If she doesn't have a job, she may be thinking that she can be losing custody of the child, another reason of her actions. Lay all cards on the table and discuss everything, if it really has to be a separation, at least everyone has taken it without hatred on each other. Let life move on, don't lose the future.

Since the divorce is already on its initial stage, the judge may decide because he has all the major and minor details of the situation and would know what really is best for the couple and the child.

I don't know anything about deportation. What I do know is if the mother of this child has all these issues with drugs and other things and it can be thoroughly proven then the father has a great shot at getting soul custody of the child.

If what you say about the wife is true and there are people who are willing to testify to the wife's character, it is almost a cinch he will get 100% custody until the wife cleans up her act.

The likelihood of her being deported is slim since she has a child in this country. She might or might not be able to get on welfare.

It depends on the stae and the laws of the state you live in.
If the father of the child can fight for and get physical custody of the child, with all the drug stuff going on with that family, he might have a chance. A chance of 50-50 is better than 0 chance. Please check with the father's attorney, and also INS. I wish the father and the child the best on this one. Take care.

Get as much documentation of her and her mother being irresponsible and there wouldn't be a judge in the country that would even think about giving her custody of your child until she was clean. Keep good records of her comings and goings and use it to fight for the life of your child and maybe even hers, your child will need her mother around or a female role model.God Bless and Good Luck.

If he divorces her and takes her to court for custody and gets it she should get deported because she will no longer have the child as an excuse to say in the states. As for 50-50 custody, he can get full custody if he's willing to pay for a lawyer that will stop at nothing to prove her as a unfit mother and gets him full custody.

I can tell you that if you think you can get her deported, the US Gov is way too slow to do anything for you and they have so many loop holes she could probably commit mass murder and STILL not get deported. AND she will probably get custody of the kid too. We need to seriously think about changing laws in this country to protect our OWN citizens and figure out a way to get our government more responsive to OUR needs. I was hoping 9-11 would change all that but nope.

I feel for you. I'm at the end of my divorce (1 child, 19 months old.) Sounds a bit like my ex. Unfortunately, the system is very biased towards males though in their wisdom they did not grant custody to my ex. Good luck!

She has a snowball's chance, especially if she is not a citizen. I just hope she doesn't find children's services knocking on her door soon. This is a tough case. Sorry, but I really don't know what else to tell you.
