Hi,
I have my wife yahoo password through the use of keylogger in her pc. Now i can access to her email without her knowing. However, is this legal if i will to bring out issue from my findings? As such information may be use for legitimated purposes.
Pls advise, esp from those who practice law.

Hi,
Thanks for the feedback, my findings as below:
My wife has planned a tour with her Ex-boyfriend, without my knowing. She has booked a double-bed room in the hotel. No doubt, both will spend few nights together.
I dont hire a Private Investigator to tackle this situation, but i have findings to show that both names in the flight itinerary and 2pax/rm were mentioned in her hotel's voucher.
Does the above able to define as adultery? Else to what extend is considerable? Moreover, my wife has been asking many times for a divorce recently.

It depends on the laws of your state, but most likely it is not criminal. You will be invading her privacy, however, and she would be able to sue for any "damages" that result (unless your state has husband-wife tort immunity statute).

It is not only immoral, it is also illegal. Most laws have federal acts that protect the information that can be obtained from a civillian or law enforcement. From a legal standpoint, a computer is like a locked file cabinet. It can only be opened and have information retrieved with the permission of the person in possession of the information. Law Enforcement even has to obtain a separate warrant to be able to search a computer. The information retrieved most likely will not be admissable in court. Consider this: If you don't find anything that will make your wife look like an unfit spouse, if she catches you going through her email it will make you look worse than any suspicions you may have of her. Consider that the most sacred piece of marriage is trust; if you violate that you are no better than her (if she is doing anything aloof). My suggestion to you would be to hire a private investigator to tail her or whatever. If you suspect that she is breaking the law; call the police. Except for cases of adultery - most states do not prosecute for that anymore. If you confront her and don't like her answers, then you have yours. Either way - stay out of her email and IM's and other such electronic communication devices. It is illegal and will do you no good to support anything in a legal battle of divorce.

Of course, you are her legal partner..... but cannot use it because As per the Internet rules, u cannot access her mails as to her personal details.

You just don't let her know that u r using accessing her id. Also, note down details and catch her red-handed. Present your case in the H'ble Court that u got information from outside sources which u don't want to name them.

OK?? Then, go for it. Also, what your wife is doing is not legal. Because if that person is having some relationship for example say..... Physical then, that person is doing an offence called adulteration. If there is no relationship like that then, trust your wife fully and also tell her that you are using her email id. But, play the whole game in order to bring the truth in light and ultimately in the interest of legal justice..... Sameer [LL.B.].

Wow... I guess if you are looking for information based on legitimate concerns of inappropriate behavior it could be acceptable...

I know my spouse's passwords and he knows mine we've nothing to hide, but to be honest, I don't check his account unless he calls for me to look for something.

If you however, are a jealous person with unfounded reasons ...You should be ashamed.

As to the legality of it, a judge would decide based on relevant case law. It may or may not be admissible in court. I do think you would be looked down on unless you had very-very good reasons for doing this.

Remember your spouse is not your child! Only you know your situation, Only you can make the right choices in your individual circumstance.

If you have legitimate concerns, speak to an Attorney in your state. There are several websites that you can ask an attorney a question...It may take a few days to get an answer...

Marriage is healthy relationship and belief and love in each other unconditionally all about.
It is very clear relationship between you two is not healthy anymore ,otherwise why you don't ask directly to your wife whatever you want to know from her id.

Think about the situation when you don't find any thing against her and she actually believe in you from her bottom of heart.

You will not be able to offend yourself then,
In that case your smooth going life will become like hell.

I know one lady who use to visit my city for her official work and use to share one room with her colleague. Will you define it as adulatory??
If you are very sure she was in that hotel with her boyfriend then what are you waiting for give her divorce as soon as possible if this divorce don't put you in financial ****.(Real Male don't listen to others)

An educated wife may permit her husband when she is confident about him. My wife joins me to say, 'This also brings bonding with each other, but with permission'. Both of us know and also open others mail. It saves our mutual time. No hiding amalgamates mutual faith and love. But for official secrecy and/or India's security it should / must be secret to the power infinity. Let's not talk about legal as it is obviously illegal to know others mail ID be it wife or anybody else without permission.

Not legal. Invasion of privacy since the keylogger was on HER computer (as you stated). If she used YOUR computer, then it's a different ballgame.

Just move out and proceed with the divorce and move on...don't lower yourself to being a sneaky fool.

do not listen to these other son here most of them are wrong. You need to give more information, what state are you in? i know you said it was her computer, however do others use it, you or kids ?
p.s. just remember they do not need to know you used key logger, she could have left the computer turned on with her e-mail account logged on
do you have a computer, does she use yours, maybe it was your computer she used with the key logger not hers!

I don't think it's illegal. Does it make you a schmuck? Absolutely. It's never right to snoop on your spouse like that and it will only end badly. If you distrust her that much, why don't you just leave her for pete's sake?
