My sister just had a baby, but because of it she had to miss her class at the local college. Now they are saying that she has to take the whole class over angin and pay for it too. Is this legal, and if it is, is there any loophole around it?

Is this legal, and if it is, is there any loophole around it? She was studing to be a medical assistant and had very good communication with the teacher, the teacher wants to let her slide, but the school won't let her. The class had only four days left and she missed those four days, but the teacher also started the class one week after the schedualed date(i dont know if that matters or not).

i am pregnant and in college italked to my professors and told them i might miss a few classes and wanted to know if this posed a problem. they all are very willing to work with me every way possible. odd they wont do the same for her.

It depends on how many classes she's missed, and whether or not she's communicated with the instructor the entire time she's been gone.

At my school, your instructor can give you an "incomplete." It's not an F, and it gives you an extra quarter/semester to finish your work. If you don't finish the work by the end of the next quarter, the grade automatically turns to an F, and at this point you would have to take the class over again and pay for it.

If she's missed classes both before and after the birth, and her professor has not heard a thing from her at all (even though it's obvious that she's pregnant and would have a lot of doctor visits or might not always feel like coming to class), I can honestly say that I wouldn't work with her either.

If she's been responsible throughout the class, then no it isn't fair, and she can appeal the failing grade.

by law the school has to give her 6 weeks when she has the baby (it is considered maternity leave) off unless there is a medical reason as to why she had to miss more then 6 weeks.

Anything more then 6 weeks without a medical reason is not the schools problem and they do have the right to fail her and to make her pay for the class again.

If she only missed those 6 weeks and some time due to medical reasons then she should take action but im not sure what exactly she would do, perhaps she should try talking to someone like the dean or some type of counselor.

There isn't much the professor or your sister can do if that's the school's policy. My friend was also studying to be a medical assistant when she had to be hospitalized because of difficulties with her health (she had double pneumonia and suffers from lupus). She was almost done with her courses but they wouldn't let her slide and now she has to take them again while also starting her internship over. It sucks but some schools are very strict with their policies.

You would think that her professors would know that she would be missing some class time. It's not exactly easy to hide the fact that one is pregnant. I would suggest talking to whoever it is that is in charge of students taking classes. They shouldn't make her pay for it again though. That's just ridiculous. They should just let her make up the classes and the work that she missed.

You can tell your sister to fight till the end...I am going through something simular but instead I had jury duty and they are holding the days I missed against me...What she will probably have to do is file a absentee appeal in student services but legally no they are not allowed to do that because every where has a maternaty leave (jobs, schools, etc) so if I were her I would most definatly fight

Yeah that's proper order you can't just do a little of the semester then stop and start ...So she has to re-do it from the start But they could give her a break on tuition fees

how far was she into the course.. she can finish studying on her own and just challenge the test... I mean she paid for the whole thing already inculding the exams

No, they should give her Ph.D. immediately becuase she has accomplished such a complex task of spreading her legs and reproducing. What could she possibly learn in a class after that?
