Which is better and why?

Legal marriage is better in my opinion for the simple fact that I don't think the government should be able to say when you are ready to be married. It should be a choice. If you live with someone for 50 years and never actually say "I do" then you are NOT married. The government doesn't have the right to say otherwise.

Depends on the state. Texas for example fully accepts common law marriage as a legal marriage and you can even have it recorded in the county records office. So in a case like this I dont see what the difference is seeing as both are legal. 11 other states consider it legal as well. Check it out on the link below.
If you are in one of the states listed in the link you go through formal divorce as you would with legal marriage. (I thik many of the answers here reflect the misunderstandng of the legal upholding of a common law marriage in some states)
So I am kinda confused better for what exactly?

they are both the same as long as your state recognizes common law marriages. Then if you split you are still required to get a divorce and are entitled to the same thing as a couple who had an actual marriage. A common law marriage IS a legal marriage so they are the same thing.

I feel that Legal marriage is the best and here is why. It is on paper and you share the same last name and when you have children they are more secure and have the same last name as the both of you. Saying your vows to each other is romantic and means something that should last forever. It is a lifetime commitment and great. Common Law marriage is no where secure and commited as this. This also means that you are married and God smiles on you and blesses your marriage BUT God does not like shacking up and just living together with sex outside of marriage.

Common Law Marriage is when you are living together, it is playing house for those who are not ready for Marriage. Legal Marriage is when you are committed to your spouse for life. Which is better depends on what you want in life.

Common law is a way to have a mate and beneifits without finalizing the bond--getting married. it is usually an attitude issue--formed out of mistrust, lack of respect, and bordering on a lack of integrity. You may find yourself outside with nothing after a few years of living common law. Common law says " you will do for now, but I may get another when I want to". Oh, I doubt love is in a common law relationship--just a smooth talker who convinced someone to move in.

With a legal marriage, you have all rights to everything he owns; being a common law wife means, he can drop you as if you were a bad habit and leave you with nothing to show for it.

it's all a matter of preference. Either way you will encounter legal matters once the relationship is over.
