I have a friend who is currently 20 yrs old. 1 1/2 yrs ago, she was stupid, met a man off of a phone chatline, went with him to a hotel where he drugged her and held her captive for 2 1/2 days and raped her. There was obviously no evidence, as she didn't go to the hospital afterwards. She knows his name but not where he is. Any advice for her to help her get justice?

It depends on where in the world you live. In the United States, 1 1/2 years is not a very long time in the legal system. What the rapist did to her constitutes several major felonies, all of which can be reported several years after the event in almost all states. Even if the police do not refer her case for prosecution (or if the prosecutor does not take it) they can use her report to build a case against the rapist. If they know who he is, they will know who to investigate.

Whether she reports to the police or not, you should ask her to make contact with a rape crisis center. They can help her with the impact the rape has had on the rest of her life. They can also give her more advice about reporting in her local area. If she lives in the United States, she can call RAINN at 1.800.656.4673 and they will refer her to a local rape crisis center.

Yes. I helped a friend with a similar situation.

First off, its very unfortunate that she waited so long because the best evidence for such cases goes away after just a couple of days. That evidence is physical trauma and vaginal tearing.

Second, it is still possible for her to get some justice, but much less likely now. The court will be very interested in to why she waited. This will hurt her case. My advice is to find a psychiatrist who can vouch for her stating that it was out of fear or emotional trauma or something similar.

Third, knowing the name of the man is important, I just hope its a REAL name and not one made up. What is even better is getting the RECORDS from the phone chatline of the conversations and using them as evidence. You might find useful information there. ALso, go to the hotel and look ask for a record of their booking dates 1 1/2 years ago during the event. You might need a warrant for this so you may have to file the report first.

In the court room, don't dispense this info until after the man has claimed it never happened. That way you can demonstrate him lying.

I would have her report this man to the local police. Even if she just knows a name and can give a description that may be helpful. This man sounds like a real predator and will probably commit a similar crime in the future at which time your friend's report may be useful.

Well.....she waited along time, you should normally report a rape right after it happends, because now their is no proof that she was raped. If she wouldnt have waited she could have gotten a rape test at a local hospital to get evidence that she was raped, and possibly could have gotten DNA evidence from the rapest.

She should just talk to a lawyer.

I can't say for sure for your area but to my knowledge there is no statute of limitations on either rape or false imprisonment. So she should be able to report it at any time. As for tracking him down the police should be able to do something about that, or at the very least a warrant could be issued that would get him picked up by any law enforcement agency that stops him.

She should go and report it as something which happened. It is probably happening to other women. I think there must be evidence to prosecute, but if someone else is attacked the same way but reports it, your friend may be able to add her experience into that case.

That is really a shame and a crime!

I would says, regardless of the time it is important to report this man. There is a chance he is still doing it. A name is a good lead.

she should go to the police. maybe she can identify him, and stop him from doing it to someone else. there might be other evidence, even if she didn't go to the hospital - e-mails, phone records, other crimes he's committed, etc. besides, if they catch him, he might confess.
