I have come to the conclusion, that Divorce is my only option, but i'm unsure where to start and what to do?
we do have a child and agree I will have custody,besides the child theres nothing such as house savings or cars, are lawyers needed? what do i need to finalize it? where do I go to do it?

You can do it yourself just get the kit from family court or see if you have "We the People" in your area, they are very affordable and will fill out paperwork for you. Good luck

You will need to find an attorney and everything that is agreed upon has to be witnessed and you definitely need to touch base with a lawyer for all of this to be finalized. Even though you are in agreement right now for you to have custody, if your husband gets the least bit ticked off with you, he could change his mine and then what would happen. You need to look in the local telephone directory and look under attorneys and find one that specializes in Divorce or Family Law cases and go in and expalin your situation and they will tell you your options and they can give you a rough estimate of how much it will cost. If your husband is the one that is making you get the divorce then you should make him agree to pay your attorney's fees. I have already been through it and have come to the conclusion that if you all can come to an mutual agreement about things, this will help you a great deal. Are you going to file for child support and make him pay this---if so, then you will have to go through the attorney to go through the courts, or you could go to your local Department of Social Services, and expalin your situation and they can enforce child support out on him. Since both of you are in total agreement on the biggest part, sit down and put the agreement to paper with every detail especially concerning the child, get it notorized and file with your local court as a simple uncontested divorce. You might want to get at least a Paralegal (yellow pages) to do your paperwork. There definitely is no need to get an expensive attorney here unless something changes. Sorry and good luck

You have a child so there will be custody/support issues and yes you need a lawyer, if there is any debt it is split equally...if you have any joint accounts they will be split equally. I suggest calling lawyers in your area and getting first consultations with a few pick the ones that offer free first time consultations, then go with the one you feel will help you the most.

Try a mediator. It can save a lot of attorney fees and is fair. You'll both have to agree on the terms or it won't work. Look in the phone book for a "legal clinic" for a referral. You can also look under "mediator". Good luck and I hope you can continue to agree on the child issues.

If you have money, go to a lawyer and let him do the work.

If you don't have money, go to the family court. They will do it for you almost free of charge.

In your case, the main issue is child support. He will have to pay 17% of his income (before taxes) to you for child support and it has to come as a court order

since you have a child yes you need a lawyer to say you want custody it will be in your divorce decree the lawyer will exsplain it to you just ask and he'll tell you the court date call a lawyer in your state

you could pay a paralegal to do it or you can do it yourself its very easy and lots of times they have information on the Internet that will help you get and fill out the forms here in CA theirs a web sight that is called Ez legal help and you just input your information and it fills out the forms for you and all you have to do is make copies and submit it to the court. good luck
