I want to start a new company called, say, Bay Valley Software. Within 50 miles there is a Bay Valley Church (non-profit, if that matters) and a Bay Valley Optometrist (for profit). Can I still use "Bay Valley" in my company name?

You shouldn't have any problems with that kind of naming. One, Bay Valley is an area description, two, people are not going to confuse a church or optometrist with software. Most problems come when you name your new company with a name similar to an existing, well recognized name in the same field. If you wanted to name your new software company MacroSoft, or a new soft drink CocoaCola, you would have problems. Just look in the phone book and see how many business names start with AAA (to get first or close to first listing) or with your city's name.

I think it's only a problem if you and the other guy have the same type of business. Another software place with same name would be bad.

You are fine. specially if it is a location or city name. It is not a copyrighted name.
