If she lives with you, you might be able to claim 'head of household' and do that.

You might be able to claim your girlfriend if you meet all of the following tests:

1. She cannot be the qualifying child of another taxpayer. If her parents can claim her, you can't.

2. She must have lived with you for all of 2006.

3. She must have had less than $3,300 in gross income.

4. You must have provided more than half of her support for 2006.

5. Your relationship must not be illegal under local law. If there is an ordinance against cohabitation, even if it's not enforced, you cannot claim her as a dependent.

You CANNOT claim her daughter. Her daughter is the qualifying child of both of her parents and this bars you from claiming her as a dependent.

You cannot claim Head of Household.

If she lived with you ALL year, not just part or most of it, and she made under $3300 total all year, and you provided more than half of her support, then you can probably claim your girlfriend. Claiming her would NOT qualify you to file head of household though, you'd have to file as single.

You would not be able to claim her daughter, since she is her mother's qualifying child and not yours, even if her mother isn't filing a return. Rules on this changed a couple years ago. It doesn't matter whether you supported the child all year, you still can't claim her.

To answer your question more fully I'd have to have more information. For instance, are the three of you living together, does your girlfriend receive financial aid in order to pay for her college tuition, are you responsible for more than 50% of your girlfriend's support, and are you responsible for more than 50% of her daughter's support? If she is receiving financial aid and she stated on her FAFSA that no one was able to claim her on their taxes, then you cannot claim her as your dependent. However, if not, and you are supporting her financially, as well as her daughter, you can file as head of household and claim the two of them as your dependents.

If ur gf lived w/u for a whole year last year and you provided more than half of their cost of living and no one can claim her, yes. Your girlfriend can claim her kid; if the kid has a parent that is claiming her(her real dad or mom), then u can't claim her kid. you must have a dependent to be head of hsehld
