We had one here in Western NE that received probation because he was 5' and the judge said he was to small for prison and would be victimized. I say yea, and the problem is? Let him get a little of what he gave, sick little f*#%.
If you have sex with a child you should be killed or at least "modified" so it's impossible for you to do it again.

Well...maybe Fox is inaccurate. They have a history of inaccuracy. Sentencing is pretty much done under sentencing guidelines, which are not flexible and not subject to interpretation so it is difficult to believe that a judge could, or would, violate the sentencing guidelines for a child molestation case. Barring that, there might be extenuating circumstances. I am not going to google to Fox, they have too much history of lying for me to ever trust them. Perhaps it was merely a technical case, like an 18 or 19 year old flirting with a 17 year old. Perhaps a 17 or 16 year old led on or lied about age to an 18 year old. In any event, Fox is unreliable as a source.

I heard about this story - eons ago.
Without knowing all the details, I can't fairly answer the question. But morally, I don't think a child molester should ever walk free again. I think that we should put them to death - studies show they can never be rehabilitated (oh, that conservative gene is raising its ugly head again. . .), and once out, they molest again. It is something that is very wrong, and should be dealt with. Giving them probation is not dealing with the problem. All it does is get the country pissed off, and get your name on the news as a judge that is an idiot. . .

He knew the guy would get no medical care if sentenced and he needed him in medical care. it is unlucky that every person is erroneous sufficient to think of latest child molesters would be taken care of because of the fact i don't think of that has EVER worked. He replace into hamstrung by skill of the regulation saying mutually as in detention center they might't get medical care however the state will provide medical care if he's not in detention center. Screwed up for effective!! No medical care or detention center sentence will ever make up for a manner he messed with those toddlers' brains and futures in need of existence with out parole.

shameful behavior on the part of the judge. if i lived in his city/town i'd push for his removal from office. the message this sends to the victim is despicable.

I cannot answer your question, but perhaps there are factors that mitigated a softer sentence. Don't know for sure.
