If an aircraft flies over it, is that trespassing ? Can I shoot it down for illegally entering my airspace ?

Hi Ivan,

Yes, you do own the air above your house and garden but aircraft may fly over your house without being a trespasser. If he lands in your garden without good cause then that would be a different matter. No, you can't shoot it down, for some reason the authorities don't like you doing things like that, something about endangering life or some silly thing like that.

I believe its the case that you own the airspace up to the highest projecting item on your property.

You own the ground below to the core of the earth.

Therefore nope, the aircraft are not trespassing, well unless they're very low indeed...

Define "directly"

Even if you continue to own all the way up, you have granted a right to pass through for birds, airplanes and satellites in orbit. The closer you are to an airport, the less high you can make a structure on your land.

i was wondering this myself the other day. no, not that i wanted to shoot anyone down. but i was thinking more in terms of a helicopter flying in really low to take pictures or just to nose around on my property. i can see it being a danger issue if by doing so they harm any crops or cattle I have on my property. I think I should own at least a few hundred feet of air above the ground of my property.

No, you do not own the air space. You own the land and the buildings thereon.

In fact, it actually became quite difficult to create titles and thereby proving ownership to "skywalks" when they became popular.

Also, you only own so many feet down into your land. I dont know the exact footage and nevertheless I think it depends on where you are and the governing land title authority statutes.

No. Air rights are non-transferable. In most places neither are mineral and water rights. The government retains these (either local or federal)

You own up to Heaven and down to Hell. Aircraft have a waiver to pass over your land so you cannot shoot them down legally

I dont see why not! why the hell should we have to put up with some fancy pants fly boy buzzing our properties in his latest noisy toy. We should create exclusion zones and get some surface to air missiles.
