can the person on deprortation status stay in usa if she have an american baby after fight the court and proove for the judje to have the right to stay in usa

It depends on which country you're being deported to, but in light of the fact that the US does not generally deport illegal immigrants to countries with dire human rights records, unless you are more than 32 weeks into your pregnancy by the time you leave (they cannot force you to fly so late in your pregnancy for safety reasons) your baby will be born outside of the U.S.

Note that you have no chance of being allowed to stay in the US after you have received a deportation order, even if you have a baby whilst in the US.

No. Having a baby in U.S.A. is not a legal reason to remain in the Country. The baby, under current laws, will be a U.S. citizen so you decide if you want to turn your baby to the government for foster care or take the child with you when you are deported. Then begin the process of returning legally.

It would be a stupid reason and cruel for a child to get pregnant and have the U.S. support you and your baby.

You don't even have to be a lawyer to answer this one. Think about it for a moment. If any illegal knew that, if just by giving birth in US soil, she would be able to stay legally in our country, what do you think would happen? Our country would be invaded by pregnant women in order to use said "benefit", of course, using the medical and social benefits of living legally in our system. The answer is OF COURSE NOT, they are still illegals, so they would be deported. The child would be a legal US citizen, not the mother.

Mom goes, baby stays. That's the law. She should have come here legally. Period.

the child can stay but the illegal mom will probably have to go, she does not have the right to stay.
