You need to have a resident's permit or visa, else you're an illegal immigrant. This is applicable to any country. Only South and Central Americans who do not fulfil these criteria are "illegal".

To enter a country legally, yours or mine, one applies to do so legally, at least a time-sensitive visa. Otherwise one is illegal, and illegal is illegal - that means having broken one or more punishable laws.
In simpler terms you cannot come into my home without my permission either.

Because they are citizens of their own country and not citizens of the U.S.. Same as U.S. citizens illegally entering other countries would be considered illegal.
We welcome immigrants but they must obey the law.
