My has to go through a series of classes to get rid of his misdemeanor. He's moving to NY so he has to transfer the case to NY and attend classes there. The problem is that he was only intending on staying temporarily but his classes are 6 - 9 months. Will he then be able to transfer his case back to Miami and finish up here? Or will he have to finish it up in NY once it becomes a NY case?

We already looked into it and there's no problem transferring from Miami to NY. It's transferring back that I'm questioning?

He has to finish where he starts or start over in the other state.

I don't believe he'll be able to transfer it until he becomes a resident of whereever he's moving.

So if NY has a 1 yr requirement to be a resident - then he can't transfer it for a year.
