This is about my wifes first child,, she gets $9.13 per month ,, by court,, I can not understand this! What judge would think that would even feed the kid two days? I know he works under the table jobs to avoid child support,, ! Why don't they get after these dads ? ,, Is child a. worth $9.13 and child b. worth $400 per month,? I know I will get answers saying it's based on the fathers wages,, but should it be ? Is the question?

I make money ,, I'm upset about the system,, cause I know I would pay out $400 per child if I ever had to pay child support! .. my co-worker pays that ! Sorry to the gold digging chick . life must be so handed to you! Good for you!

too add to this I feel that a man should get the same ,, say if the dad had the kids ,, I'm not just saying dad's fail to pay ,, many dads have their kids, with moms not helping their own offspring! ,,,, This whole subject is just sad! I know I would provide for my kids NO MATTER WHAT,, anyone that would not is not the man,, or woman!! SAD!!!!!!!!!!!!

That happened to one of my friends too. It does not make any sense whatsoever.. she got so fed up that she told him to keep his $6/month. As for anyone who thinks a woman does not deserve child support for her child, they are obviously with someone who has to pay for their child and is being selfish. My husband pays for his 2 kids with his ex (we have one together) and we are proud to support ALL of our children. As long as the woman isn't being selfish and asking for increases all the time instead of bettering herself first, I don't see anything wrong with child support. There should be a minimum men have to pay but there are some loopholes and it is not fair to the child. they should at least impute his income to minimum wage - anyone can make that!!!!

Wow- all these answers are different. Actually - it is only if the Ex decides to take him back to court. Even if it gets modified every 3 years - when they do that - they don't ask for his paystubs - they do a 'cost of living' amount (not based on how much more he earns) - so, No, not unless the ex personally asks for an increase - but, just make sure he doesn't rub it in that he has extra money from this job- because that would be a reason to get it increased

I understand your anger. There should be a minimum that the other parent should have to pay but there isn't at this point. The laws are getting tougher on dead beat parents but not tough enough. In many states child support is based on both parents in come and the amount of time they have the child. Don't give up and take him back to court for an increase.

Wow, some of these answers shows the ignorance of people in general. She should take her case back to court and have it reevaluated. Tell them that she knows he works under the table and try to find out where he works, if you can. Call his employer and threaten to turn them in for not reporting that he works there. The employer will have to pay a big fine if they are caught paying under the table and if they don't take support out of his check.

It's not your wife's fault this guy turned out to be such a big loser. No one would pick out a loser on purpose. People lie and misrepresent themselves and you won't always know. And for the people who think you will know, they are an idiot just waiting to get taken advantage of.

Good luck to you and your wife.

Because he is a loser and knows how to work the system to his advantage. If I were your wife, I would take him back to court for more money. She may get a different judge, one that will realize that $10 won't even cover school lunchs for a week. If it isn't enough, she should have her case re-evaluated.

As a mother,it's very unfair. However, the father has to make a living for himself and if he's not making enough to take care of himself, child support won't be much.I guess child support was made to be fair for fathers. That's why they look at the fathers wages and decide what he should pay rather than looking at what the child needs.

WOW, that's really sad......my dad had tons of money and he didnt pay ****, so I dont really think the wage has much to do with it. Sometimes the court will decide that the father shouldnt even pay, which is what happend to me.

The system is really screwed up, either father's get sacked hard or they don't get hit at all.

NO, he can not be paying that small amount, for they should have applied at least a minimum wage amount to the case, its the law (in most states). courts are supposed to calculate it by minimum wage. that is an outrage.

AND I WOULD REPORT I, in writing... : to the state, feds and district attorney (whoever oversee's the judges in your county).

look, most of them try that working under the table business... you need some heat on the case.

you need to write a letter (she does). in it give her contact info, case number, copies of stubs of the amount /court order, his info, and tell them you respectfully request that the state and federal laws be applied to this case.

then take that ONE letter and FAX it to:
1) your states Attorney General (link is below)
2) your states Govenor (link is below)
3) your states Regional FEDERAL Child Support Office (link is below)

if he lives in another state,,, then to his state offices also.

phone calls are useless; ignored, denied, forgotten. mail ends up piled into someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you hear nothing in a week, FAX it again. fax it weekly until they respond and act.

THEN you need to report him (in writing) to the IRS

LINKS; just click on your state and find what he should be paying if done by minimum wage job. in most states, they calculate both parents incomes, and if one parent isnt working, a minimum wage job amount is calculated in for them (by the court).
