were both under eighteen, i'm 16, he's 17. is that technically illegal?

In some states he could be in trouble. Two people under the age of consent can have sex with each other without legal ramifications. If an adult is somehow knowingly involved or providing a place for it they can be charged.

In some states yes. I would be careful about which state you are in. In some states the older person who is still under 18 has been charged, found guilty and forced to register as a registered sex offender. That is a title you don't want to carry around for life.
You'd end up as a fry cook because you couldn't find a better job.

I don't think it is illegal, as long as it is agreeable with both you and him. The parents might have a different idea, so you have to be very careful. When I was 19, my girlfriend was 16, her parents told us both, "be careful", they didn't want anything to happen. In a round about way, they were agreeing, to us having sex, and I think they kinda knew that it would happen some day.

Technically you can give consent at the age of 16, but if you do use protection!

depends on the state that you live in. here in texas 17 is legal to consent to sex as an adult. the law under 17 is as long as you are within three years of each other as far as i know.

not necessarily. If the age of consent is 18, the cops will probably not enforce it unless a parent makes a complaint.

No the statutory rape laws are for children under 16
